Eligibility & Age Restrictions

You must meet the minimum age requirement for your region to use Vitrai:

• General (Most Countries): 13 years old.
• South Korea: 12 years old.
• Brazil: 14 years old.
• By using Vitrai, you represent that you meet the applicable age requirement and have the legal capacity to enter into this agreement.
• Minor Protections: For users under 18, we apply high-privacy defaults and actively avoid addictive design patterns, adhering to age-appropriate design codes (such as the CA Kids Code). Parental control tools may be provided where applicable.

Nature of the Service

Vitrai is an AI-powered spiritual assistance application designed for guidance, educational content, and personal growth.

Informational Purpose Only – Not Professional Advice: Vitrai's AI is not a licensed counselor, medical professional, financial advisor, or legal advisor. Always seek advice from qualified professionals for critical matters.

No Clergy-Penitent Privilege: Communications with VitrAI do not constitute a 'religious confession'. Your interactions are not protected by clergy-penitent privilege or similar legal doctrines, and may be subject to lawful requests from authorities.

Account Registration and Security

Certain features require an account. You agree to:

• Provide Accurate Information: Valid email and secure password.
• Secure Your Account: Confidential login credentials.
• Responsible Use: You are responsible for all activities under your account.
• No Multiple or Fake Accounts.
• Processing of Special Category Data: Providing data that reveals your religious or philosophical beliefs is strictly optional. Processing this sensitive data requires your explicit consent, which is requested separately from these General Terms.

Token System and Subscriptions

Vitrai uses virtual credits ("tokens") to access premium features.

Payments and Auto-Renewal

Transactions are handled through authorized app store platforms.

• App Store Billing: LVIM LTD does not directly process payment details.
• Subscription Auto-Renewal: Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date.
• Cancellation: Must be done via your app store account settings (Apple App Store or Google Play) at least 24 hours before renewal.
• Refunds: Digital content is generally non-refundable once delivered, and all unused tokens are forfeited upon termination, except as expressly required by applicable local digital consumer laws. For subscription refunds, contact your app store provider directly.
• Renewal Cooling-Off Period: For yearly subscribers in certain jurisdictions (such as the United Kingdom under the DMCC Act 2024), a right of cancellation and pro-rata refund may apply within the first 14 days following a renewal.

User Conduct

Use Vitrai lawfully, ethically, and respectfully. Strictly prohibited conduct includes:

• Harassment, bullying, or hate speech.
• Illegal activities or unauthorized promotions.
• Reverse engineering or interference with the service.
• Spamming or manipulating community features (e.g., Prayer Intentions) with automated tools.
• Anti-Manipulation: VitrAI commits to not employing subliminal techniques or algorithmic manipulation intended to bypass your autonomous decision-making.

AI Content and Disclaimer

Vitrai's functionality involves generating content using advanced AI models (such as GPT-4 or GPT-5-nano).

• Automated Content: Not pre-written by humans.
• Potential Inaccuracies: May contain mistakes or misinterpretations.
• No Professional Advice: Not a substitute for professional evaluation.
• Machine-Readable Marking: AI-generated outputs are designed to be identifiable and may carry metadata or watermarks in compliance with transparency rules (e.g., EU AI Act Article 50).
• Crisis & Self-Harm Response: If the system detects language indicative of severe crisis or self-harm intentions, the AI may refuse to generate standard responses and will prioritize directing you to professional emergency resources or hotlines.
• Algorithmic Fairness and Bias: We strive to provide unbiased spiritual guidance without discrimination against any religion or sect. If you encounter biased outputs, please use our in-app complaint mechanisms.
• No AI Training on User Data: The personal prompts and spiritual data you provide are NOT used by VitrAI or our AI partners to train or fine-tune underlying foundational AI models.
• Periodic AI Disclosure: You will receive periodic in-app notifications (e.g., during extended sessions) reminding you that you are interacting with an AI system, in compliance with regional safety regulations (such as California SB 243).

Intellectual Property Rights

All content, features, functionality, trademarks, logos, and software associated with Vitrai are the exclusive property of LVIM LTD or its licensors and are protected by international copyright, trademark, and other intellectual property laws.

• You may not copy, modify, distribute, sell, or create derivative works based on Vitrai without our express written consent.
• User-generated content (such as prayer intentions) remains your property, but you grant us a non-exclusive license to display and distribute it within the app.
• Bible texts are subject to their respective licensing terms, available in Settings → Bible Licenses.

Termination

Either party may terminate this agreement at any time.

• Termination by You: You may delete your account at any time via app settings or by contacting support@vitrai.app.
• Termination by Us: We may suspend or terminate your account immediately if you violate these Terms, engage in fraudulent activity, or for any other reason at our sole discretion. For users on a paid subscription terminated by LVIM LTD without cause, a pro-rata refund for the unused portion of the current billing period may be available where required by applicable local consumer law.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

• LVIM LTD, its directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses.
• Our total liability for any claims arising from or related to these Terms or your use of Vitrai shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or one hundred US dollars ($100), whichever is greater.
• We are not liable for any spiritual distress, emotional harm, or life-altering decisions (including but not limited to resignation from employment, divorce, or relocation) made based on AI-generated content.
• Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above limitations may not apply to you.

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

• We disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
• We do not warrant that Vitrai will be uninterrupted, secure, or error-free.
• We do not warrant the accuracy, reliability, or completeness of any AI-generated content.
• No advice or information obtained from Vitrai shall create any warranty not expressly stated herein.

Dispute Resolution

We encourage you to contact us first at support@vitrai.app to resolve any disputes informally.

General Provisions

• Severability: If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
• Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and LVIM LTD regarding your use of Vitrai and supersede all prior agreements.
• No Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
• Assignment: We may assign our rights and obligations under these Terms without notice. You may not assign your rights or obligations without our prior written consent.
• Force Majeure: We shall not be liable for any failure or delay in performing our obligations due to circumstances beyond our reasonable control, including but not limited to natural disasters, war, terrorism, pandemics, government actions, or internet/infrastructure failures. Service availability is subject to the uptime and availability of third-party AI providers (such as OpenAI). VitrAI shall not be liable for service degradations or interruptions caused by third-party infrastructure failures or model deprecations.
• Export Control and Sanctions: You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a 'terrorist supporting' country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties. You agree to comply with all applicable export laws and restrictions of any foreign agency or authority.

Modifications to the Terms

We may modify these Terms at any time to reflect changes in our practices or legal obligations.

Material Changes: We will notify you of material changes via email or in-app notification before they take effect.

Non-Material Changes: Non-material changes (e.g., clarifications or formatting) will be effective immediately upon posting the updated version with a new 'Effective Date'.

Continued use of Vitrai after the effective date of any modifications constitutes your acceptance of the updated Terms. If you do not agree with any changes, you should stop using the Service and delete your account.
